Terms of use for cactusmoving.ca and associated online forms, content, and communications
These Website Terms govern use of cactusmoving.ca. They do not replace the separate Terms and Conditions of Service, accepted quote, or signed moving or storage agreement that governs a booking.
By accessing or using https://www.cactusmoving.ca and any associated pages, quote forms, booking forms, tools, or online content (the "Site"), you agree to these Website Terms and Conditions (the "Website Terms"). If you do not agree, do not use the Site.
The Site is operated by Cactus Moving Inc. ("Cactus Moving", "we", "us", or "our"). These Website Terms apply only to use of the Site. Moving, packing, transportation, storage, and related Services are governed by the Terms and Conditions of Service and the transaction-specific documents.
Site content is provided for general information and may not reflect every service area, vehicle, crew, rate, availability, legal requirement, insurance condition, customs rule, or operational limitation. Content is not legal, insurance, customs, tax, financial, engineering, or other professional advice.
Online calculators, examples, blog posts, checklists, and price ranges are illustrative. A quote request is not a binding offer. A booking exists only when Cactus Moving confirms it in writing and any required documents and deposit are received.
You must have legal capacity to use the Site and enter a transaction. If you submit information for another person or entity, you represent that you are authorized to do so.
You agree to provide accurate, current, and complete information and to update it when it changes. You must not impersonate another person, submit false reviews or claims, misuse payment information, or provide information you are not authorized to disclose.
You may use the Site for lawful personal or business purposes connected to learning about, requesting, or managing Cactus Moving Services. You must not:
The Site and its content, including names, logos, trademarks, photographs, videos, layouts, text, service descriptions, software, graphics, documents, and blog articles, are owned by or licensed to Cactus Moving and are protected by copyright, trademark, and other laws.
Cactus Moving grants you a limited, revocable, non-exclusive, non-transferable licence to view and use the Site for its intended purpose. No other right is granted. Cactus Moving and its licensors reserve all rights not expressly granted.
If you submit a review, testimonial, photograph, video, suggestion, or other content for public use, you represent that you have the necessary rights and that the content is accurate, lawful, and does not violate privacy, confidentiality, intellectual-property, or other rights.
For content intentionally submitted for publication, you grant Cactus Moving a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display it for the purpose for which it was submitted. This licence does not apply to private moving documents, identification, payment information, claims evidence, or other confidential customer material.
Cactus Moving may moderate or remove public submissions but is not required to monitor them. We will not condition a refund, claim payment, or discount on changing or removing a review.
When you submit a form or contact us, you consent to service-related communications by email, telephone, or SMS. Commercial electronic messages will be sent only with consent or as otherwise permitted by Canada's Anti-Spam Legislation. You may unsubscribe from marketing at any time, but transactional communications may continue where necessary.
Electronic communications may not be completely secure. Do not send full payment-card numbers, passwords, or unnecessary sensitive documents by ordinary email or SMS.
Our collection, use, disclosure, and retention of personal information is described in the Cactus Moving Privacy Policy. The Site may use essential, analytics, advertising-measurement, and preference cookies or similar technologies. Where required, optional technologies will be controlled through a cookie or privacy-choice tool.
Third-party analytics, advertising, mapping, payment, social-media, video, or communication services may collect information under their own policies.
The Site may link to or integrate with third-party sites and services. Links are provided for convenience and do not constitute endorsement or control. Cactus Moving is not responsible for third-party content, availability, security, products, services, or privacy practices. Your dealings with a third party are governed by that party's terms.
We may change, suspend, restrict, or discontinue any part of the Site without notice. We do not guarantee uninterrupted, error-free, or secure access, or that defects will be corrected immediately. We may block or limit access where we reasonably believe there is misuse, security risk, legal exposure, or violation of these Website Terms.
You are responsible for maintaining the security of your device, accounts, and communications and for using current software and reasonable security practices.
To the fullest extent permitted by Applicable Law, the Site and content are provided "as is" and "as available", without representations, warranties, or conditions of any kind, express or implied, including accuracy, completeness, availability, merchantability, fitness for a particular purpose, title, or non-infringement.
Cactus Moving does not warrant that Site content is current for every province, state, route, building, customs situation, or customer. You should confirm important information directly with Cactus Moving and obtain independent professional advice where appropriate.
To the fullest extent permitted by law, Cactus Moving and its directors, officers, employees, contractors, affiliates, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from use of or inability to use the Site, reliance on content, loss of data, malware, third-party links, or unauthorized access.
Where liability for the Site cannot be excluded, Cactus Moving's aggregate liability arising solely from use of the Site will not exceed CAD $100, or the amount you paid specifically for access to the Site in the 12 months before the event, whichever is greater. This limit does not apply to liability that cannot lawfully be limited.
Liability for paid moving, packing, transportation, or storage Services is governed by the Terms and Conditions of Service and the applicable Service Agreement, not this Site-liability section.
To the extent permitted by law, you agree to indemnify Cactus Moving against third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Site, infringement of another person's rights, fraudulent submission, or breach of these Website Terms, except to the extent caused by Cactus Moving's own negligence or breach.
These Website Terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, except where mandatory consumer law requires another result. Any dispute must be brought before a court or tribunal with lawful jurisdiction.
Before formal proceedings, the parties are encouraged to give written notice and attempt good-faith resolution.
We may update these Website Terms by posting a revised version and effective date. Changes apply prospectively from the effective date. Continued use after the effective date constitutes acceptance, except where Applicable Law requires additional notice or consent.
